Terms and Conditions For Teachers

For Registration,selection and allotment:

1. You have to register in our website www.thetrajectory.in
2. Fill the teacher’s registration form(Basic details,Educational,Class & Feed,Skills,Preferences,Travel).
3. Company will conduct a small test and interview in office premises.
4. After selection we will give you classes available in your nearby location.
5. You have to give 2 demo classes before starting any classes.
6. Demo classes are countable and payable if you continue teaching to that particular Student/Place.
7. Fees is collected by the company in advance from place when the teacher is selected for regular classes after 2 days of demo and teacher will be paid in the last of the month by the company.
8. Final fee may also include any applicable travel costs incurred by the tutor. If the tutor needs to travel a significant distance to provide in-person tutoring, additional charges to cover their travel expenses may be added to the final fee.
9. We provide assessment sheet to the teachers which they have to fill and submit for receiving their payment.
10. A tutor warrants that he/she is of at least Twenty years of age,and having necessary qualifications experience to give tutoring in the categories/syllabus and subjects specified by the tutor on his/her profile.
11. Institute doesn’t take any responsibility of characteristics/behaviour of parents, students/individual person.
12. In case of any problem/dispute with parents, teachers can complain to company, company will arrange other classes for the teacher.
13. Company will not share any details of tutor to any individual/parents/anyone without permission of teacher.
14. Teachers are not allowed to change timing more than 3 times/year,until any mis-happening happens.
15. The company reserves all the rights to make any changes in services/person and program without any prior notice.
16. If the teacher is leaving any Classes,school or institute,you must intimate us prior 1 week.
17. You understand and agree that the relationship between The Trajectory Academy and you will be not be considered as employer and employee relation.
18. The Trajectory Academy reserves all the rights to change all or any of these above-mentioned Terms and Conditions with or without giving any prior notice at any time.
19. You may not impersonate any other person or entity or to use a false name or a name that you have no authority to use.
20. You here by confirm that you will abide all the rules and regulations of The Trajectory Academy.And in case if you get caught cheating with The Trajectory Academythen The Trajectory Academycan take any legal action on you.Any attempt to cheat or deprive The Trajectory Academyof its legal share of commission,will result in legal actions being taken.

Terms and Conditions For Institute

Scope of Services

The Trajectory Academy agrees to provide recruitment and placement services to the Institute.

Requirements

The Institute agrees to provide The Trajectory Academywith a clear and complete description of its staffing needs and requirements.

Confidentiality

The Trajectory Academyand the Institute agree to maintain the confidentiality of all information, including but not limited to client and candidate information, obtained during the course of their relationship.

Candidate Placement

The Trajectory Academyagrees to use its best efforts to find suitable candidates for the Institute and to arrange for interviews and placement.

Fees

Institute agrees to pay the fees as specified in the agreement for the services provided by The Trajectory Academy.

Termination

Either party may terminate this agreement upon written notice, provided that the Institute shall be responsible for paying any fees owed for services provided up to the date of termination.

Representations and Warranties

The Trajectory Academy represents and warrants that it has the necessary expertise and resources to provide the services described in this agreement.

Limitation of Liability

The Trajectory Academy shall not be liable for any indirect, incidental, special or consequential damages arising from or in connection with this agreement.

Dispute Resolution

Any dispute arising from or in connection with this agreement shall be resolved through arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996.

Governing Law

This agreement shall be governed by and construed in accordance with the laws of India.

Entire Agreement

This agreement constitutes the entire understanding between the parties and supersedes all prior agreements, understandings, and negotiations between the parties.

Terms and Conditions For Students

1. Assessment Sheet Will Be Updated by Teacher & Supervised By Parents Only.
2. We Try to Provide Our Best Tutor According To Your Requirement (based on counsellors Report).
3. Company Will Conduct Surprise Test By Mentor / Counsellor To Check The Growth Of Students.
4. Student Must Obey the Instruction of Teachers for The Better Result.
5. Demo Classes of Selected Teacher Are Also Countable & Payable.
6. Fees Is Collected by The Company in Advance from Place When the Teacher Is Selected for Regular Classes After Two Days of Demo & Teacher Will Be Paid In The Last Of The Month By The Company.
7. Teachers Are Understood as Selected Teacher If He/she Is Taking Classes After Demo (Two Days Only), After That If the Classes Are Discontinue By The Parents They Have To Pay From The First Working Day. Parents Are Only & Only Liable To Pay The Fees Of Teacher.
8. Institute Doesn't Take Any Responsibility Of Characteristics / Behavior Of Teachers/individual Person.
9. In Case Of Any Problem / Dispute With Teacher, Parents Can Complain To Institute, Institute Will Change That Teacher On Immediate Basis With Taking Appropriate Action On Them.
10. Parents Have To Keep The Receipt For Getting Services Available Up-to The End Of Year Otherwise They Have To Pay Again.
11. If The Number Of Students Change During The Session It May Vary Fees According To The Company Or Teacher.
12. We Provide Assessment Sheet & Admission Form To The Teachers Which They Have To Submit Within 5 Days Of Counselling.
13. Fees Once Paid, Not Refundable &Adjustable in Any Condition Even Student NotAttendedAny Single Class.
14. Company will not Share Any Details Of Tutor To Any Individuals / Parents /Anyone Without Permission Of Teacher.
15. Students Are Not Allowed To Change Classes Timing More Than 3 Times/year, Until Any Mis- happening Happens.
16. Company Services and Programs Are Intended For Individual Address Only. Broadcasting The Programs Though Any Means, Including But Not Limited To Through The Internet, Television, Handheld Devices And Other Devices, Is Not Permitted & Is Breach Of The Intellectual Right Of Tutor. The Company Reserves The Right To Initiate Legal Proceedings In Case Of Such Breach.

18. Customers Are Entitled To Make Payment For Teached Classes And Programs Through Online Payment, Cash Or Cheque. Should The Cheque Bounces, Fail To Be Realized Or If The Company Is Required To Present An Alternate Cheque For Any Reason, Any Banking Charges Incurred By The Company In This Regards Are Recoverable By The Company From The Issuer Of Such A Cheque.
19. The Company Is Entitled To Revise The Price Of Its Services And Programs At Any Time, At Its Sole Discretion Without Prior Notice.
20. Parents/students Will Have Access To The Services Until The Limited Time Validity (6 Tutors In One Year At Same Address) For One Child / Person.
21. The Year Starts From The Date Of Registration & Up-to 1 Year From The Respected Date. The Parents Have To Renew The Services After Completing The Tenure.

23. A Student / Parent May Apply For A Refund Within A Period Of 7 (seven) Days After Signing The Application Form. The Request Shall Be Made Within The End Of The 7 th Day From The Date Of Signing The Said Application Through An Email to thetrajectory2020@gmail.com. From The 8th Day Onwards, The Student / Parent, Will Not Be Eligible For A Refund Of The Course Fee. The Decision Of The Company Regarding The Eligibility OfA Student / Parent To Claim A Refund Shall Be Final & Binding. The Company Will Issue Refunds For Those Cases Which Are Eligible For A Refund Via Cheque, Neft Or Any Other Mode That It So Prefer. The Company Is Not Obligated To Refund The Amount By Cash.
24. Company Reserves The Right To Withdrawn Any Of Its Services Without Any Prior Notice. In The Event Of The Same, The Customer Would Be Offered An Option To Opt For An Alternate Services / Course For A Refund The Amount Paid Via Cheque Or Neft.
25. In Case Of Any Dispute Or Difference Between The User And The Company, Regarding The

Interpretation Of These Terms And Conditions, Nonpayment Of Any Claim Or Any Dispute Arising Out Of Or In Pursuant To These Terms And Conditions, The Same Shall Be Referred To A Sole Arbitrator Who Shall Be Appointed By The Directors Of The Company. The Proceedings Shall Be Conducted At Raipur Under The Provisions Of Arbitration & Conciliation Act And The Courts At Raipur Only Shall Have The Jurisdiction Over The Matter And Or For Enforcement As The Case May Be. Such Person Shall Be Entitled To Proceed With Reference From The Stage At Which It Was Left By His Predecessor, If Both The Parties Consent To This Effect, Failing Which The Arbitrator Will Be Entitled To Proceed De Novo.
28. Refund Will Be Valid Only When The Original Duly Filled Tax Invoice Is Presented Together With The Appropriate Reason.
29. The Full Refund Will Not Apply If The Services Have Been Consumed More Than A Week.
30. Any Problems Related To The Services Will Be Rectified / Replaced By The Company Only And The Company Will Not Be Liable For The Same. Company Will Only Be Able To Assist The Customer In Case There Are Any Issues Related To Teacher Timing, Fees, Dispute, Teaching Method.
31. That I Am Making Payment Of The Services As Ordered By Me With Own Consent, Freewill And Without Any Inducement Or False Representation From Any Direct Seller Or Company Itself.

Disclaimer

The Company Shall Not Be Responsible For Any Act, Omission Or False Representation Made By The Direct Seller, Which Is Inconsistent Or Contrary To The Terms Or Condition Of The Direct Seller Agreement And In Case Of Any False Representation / Omission / Fraudulent Act Made By The Direct Seller, The Same Shall Be Required To Bring Within The Knowledge Of The Grievance Cell Of The Company For Taking Appropriate Action Against Such Persons And In Case OfNon-reporting The Same To The Company, Shall Not Be Any Liability Being Fastened On The Company.
